Commercial Litigation and Appeals

Commercial Litigation and Appeals

Anselmi & Carvelli, LLP attorneys have vast expertise handling commercial disputes in state and federal courts in New Jersey, New York and around the country. We represent plaintiffs and defendants in matters ranging from breaches of contracts and commercial disputes to charges of securities violations, including matters before the Financial Industry Regulatory Authority (FINRA). Because we emphasize that litigation is often not the best way to resolve a dispute, we also assist with alternative dispute mechanisms such as mediation and arbitration.

We are frequently engaged as trial and/or local counsel in New Jersey and New York, working in conjunction with national firms and sharing our years of experience dealing with local practices and procedures.

When necessary, we pursue and defend appeals. This includes the initial filing, compilation of the record, brief writing, oral argument and evaluation of the need for additional appeals.

Our practice includes:

  • Antitrust and unfair trade claims
  • Banking litigation
  • Bankruptcy litigation
  • Class actions
  • Construction litigation
  • Contract disputes
  • Creditor rights
  • Fiduciary trust matters
  • Franchise disputes
  • Insurance coverage litigation
  • Oppressed shareholder disputes
  • Partnership disputes
  • Real estate litigation
  • Securities litigation

Our recent engagements include:

  • Winning a seven-figure summary judgment award on behalf of a distribution company in a federal lawsuit that alleged fraud and fraudulent transfer by corporate officers. We also pierced the corporate veil to impose individual liability on them.
  • Winning a no-cause decision in a federal lawsuit seeking damages and a contempt citation for Federal Trade Commission false-advertising claims.
  • Winning a mid-six-figure judgment, after an arbitration matter before FINRA, against an investment adviser on claims of fiduciary breach and securities-law violations.
  • Successfully prosecuting a wines/spirits importer’s claims in an international trade dispute with a European supplier.
  • Being retained in an international construction dispute over infrastructure in Africa.
  • Obtaining a lucrative settlement on behalf of a commercial client over an alarm company’s failure to respond to a robbery.
